judge (sic) Gloria M. Navarro, of the Federal court for the Federal enclave of Nevada, declares a mistrial in United states v. Bundy, as Federal prosecutors had withheld some 3,300 pages of documents that weakened their case, leaving the possibility open for Cliven D. Bundy to be tried a second time.

       NOTES:

  • This is Double Jeopardy, which is prohibited by Article V of Amendment.
  • The proper action for Navarro to have taken would have been to dismiss the charges “with prejudice” meaning the prosecution could not refile charges against Cliven Bundy or his compatriots, as no “person [shall] be subject for the same offence to be twice put in jeopardy of life or limb.”
