The Federal court for the eastern district of the commonwealth of virginia decides commonwealth of virginia ex rel. Cuccinelli v. Sebelius: judge Henry E. Hudson declares the individual mandate provisions of the Patient Protection and Affordable Care Act (a.k.a. “Obamacare” (a.k.a. “Romneycare”)) to be unlawful. “While this case raises a host of complex constitutional issues, all seem to distill to the single questions of whether Congress has the power to regulate–and tax–a citizen’s decision not to participate in interstate commerce.”
